Development of International Investment Arbitration in India: Emerging Trends
It is a form of arbitration where the foreign investors can seek protection for their investment under Public International Law which are independent of the remedies available to them under their domestic law. It is a unique process and it had gained limelight when the foreign investors issued notices to the Government of India to initiate arbitration proceedings for the disputes relating to investments in India. The basis of this is Bilateral or Multilateral Investment Treaties.
